Title: Is it illegal?
Post by: Kasawa Lanford on October 19 2005, 06:08 am
If an admin knows a better title, then please, change it. Like on another SMF Board, I'm unsure if this thread will be suggestive due to the ToS's of some servers

A few hour's ago I went to a friends house, nothing knew I'm always going there to fix his computer or to just hang around. Well, I noticed a stack of DVDs, again nothing knew, what WAS knew was that they where rentals (He NEVER rents DVD's, he always buy's them)

Well, I lied to him and said I needed to check his computer (I hate lieing to a friend >_<) and found out he was copying Rental DVD's to his system so he won't have to buy them: Anime's of all things. (which are licensed)

Well, my job has me looking for these types of people, and then bringing them in for copy right infringment, but seeing how my boss isn't in town (I have the week off) I can't get with him and disguss this, he's not registered on this board, but every other baord he is so thisi s the only board I can ask this question on

I need to know if he truely IS breaking the Law in copying Rental DVD's to his system, reproduction, distributing them to people around the net (it's a stupid question, since I'm already well versed in Title 17, Section 502 and 506 that govern's DVD's) but I wanted a second opinion

Any?

well from what I know, renting DVDs and copying them to your PC or recording them to Video isn't illegal as long as you don't give them to anyone else or sell them. But since you say he is selling them then I'd just have to say you'll have to suck in your gut and do the right thing. That or you can live with knowing your not doing your job and just because he's a friend he's getting let off while other people wouldn't be. It's not fair. But can't you talk to him about it directly? Do you KNOW he's distrubiting them or just keeping them for himself?

I have talked to him, and he isn't happy that I found out. In fact, he's kind of pathetic now, begging me not to report him and such. I tried to tell him that copying them is ok, but selling them is not, but his server logs already prove that he's been selling them to people so I've already got the proof in my hands, either way as much as I sometimes hate this job, I'll have to report him, he knew what my job was and I told him a year ago when I took it that if I caught any of friends doing waht he is doing, I'd report them

Either way, I hope he realize's what the consequences are

But, as a side job, my boss works as a Copyright Enforcer, so my side job is finding those who violate it (not easy trust me >_< )

Its 'Technician'

Copyright enforcer? we don't have those I don't think, if somebody is breaking the law in anyway here, you ring the police and let them handle it.

Umm, correct me if I'm wrong, but in Aus its illegal to take the law into your own hands.

Contact the police and be done with it.

It's different in different countrys mind, Remmember in the USA you can do a Citizens Arrest for a fellon. I think it is legal under circumstances to take the law (to an extenct) in your own hands over there.

We do, we just provide the evidence to back up the arrest warrent  :tongue3:

The officers seem to enjoy busting these guys, naturally we remain automounous(sp)

Here in America the police have to follow so many blasted rules and regulations that it's not even worth BEING an officer

I'd go into a rant but thats not what this thread is for :)

Thanky for the opinions everyone  :keke:
